I don't understand what makes you think that. 

The or of reset, hi_ber, and !block_lock is a global transition into the
RX_INIT state which sends LF (see figure 49-15 on page 344 of D3.0). The
three conditions are all treated exactly the same by the receive state
machine. Clause 49 completely defines the conditions that require sending
LF.

Should the RX state machine send LocalFault when HIBER or !Block lock?

Currently it only sends LF out of reset.

Clause 48 has a specific section that defines when LF should be
sent(!aligned).  Clause 49 does not.
