Although I agree that using pre-UHR PPDU might not be a best choice for a specific UHR STA, from the perspective of the whole BSS, I still believe allowing pre-UHR PPDU will make this feature
 earns more benefits.  
In the foreseeable future, I believe that there will still be a large number of pre-UHR STAs operating with a bandwidth that is less than the BSS bandwidth. Then, when the AP is serving such pre-UHR
 STAs in primary subband, there will be still available RUs in DSO subband. 
In such case, if the DSO STAs are allowed to transmit/receive the pre-UHR PPDU in DSO subband, the DSO STAs will earn EXTRA opportunities to access the wireless medium, and the medium efficiency
 of the whole BSS can be improved.  
I still don’t see the reason why we need to block such a significant use case for DSO in the specification.
 
Basically, I think it is up to implementation that whether an AP will schedule a EHT MU PPDU or UHR MU PPDU after the DSO ICF/ICR. Is there any other reason to prevent a DSO STA from transmitting/receiving
 pre-UHR PPDU when they are in DSO subband?

There will be non-DSO UHR STAs, e.g. STAs with BW equal to AP's BW or STAs with smaller BW but don't support DSO, that can be scheduled with DSO STAs as mentioned in my last email. So it's not only between
 DSO STAs. Issue is not DSO ICF; the ICF is non-HT DUP. The concept of allowing pre-UHR PPDU to be used in DSO TXOP was discussed in the past; based on the collective feedback from most of the members that was not the preference as this feature is for UHR and
 using pre-UHR PPDU for UHR STAs downgrades their performance.

Echo with Yuxin, I think the DSO ICF should be transmitted in a pre-UHR PPDU, thus the pre-UHR STAs can be scheduled in the primary subband
 while the DSO STAs can be scheduled in the DSO subband in the same time. 
It is not efficient to make the a TXOP to be DSO dedicated.

Thanks for explaining. However, I'm not sure if the DSO ICF has to be carried in a UHR PPDU? I was not able to find the supporting words.  
 
If carried in a pre-UHR PPDU, the pre-UHR STAs can decode and be scheduled conventionally. In case there are only few DSO STAs in a BSS, it would
 be a waste to dedicate a DSO TXOP. Please clarify. Thanks 
 
 
  
Pre-UHR STAs can’t be scheduled with the DSO STAs because pre-UHR STAs can’t receive UHR PPDU. But non-DSO UHR STAs can be scheduled with the DSO
 STAs. 
 
Per-UHR STAs can still be scheduled on the non DSO TXOPs.

I see the following statement. Does it mean pre-UHR STAs are excluded from the current schedule? I expect that they can be scheduled within their
 corresponding operating bw by the AP together with the DSO STAs via the DSO ICF. Could you clarify? Thanks
