The IEEE has no way to track which groups are operating under one version of what rules and what groups are operating under others.  This applies not only to the patent policy but also to any other rules, e.g. new rules on domination.  As a group moves forward in their process, they operate under the rules then in effect for that checkpoint in the process.  So, if you have submitted an LOA (and it has been accepted) that does not include the language on notice and binding before 30 April 2007 then you do not have to make that commitment for that essential patent claim(s).  If you submit an LOA on May 1, 2007 then you do.

Rules change (sometimes significantly but usually just to some degree of specificity) all the time in the IEEE and the working groups seem to handle it fine.

OK.  So if a company already has submitted a LOA prior to April 30, then it does not have to submit a new form and/or comply with the new aspects of the new form (such as agreeing to seek to bind transferees, etc)?  I confess that I still am a bit confused.
 
It seems to me that many standards bodies that have made changes to its IPR policy and related documentation often take the approach that the new policy kicks in after a certain date and on a project-by-project basis – essentially when a technical committee begins a new project (which can include a revision to a previously approved standard).  This is so that everyone working on a given project is operating under the same set of rules and expectations from start to finish.  There sometimes is a perception of unfairness if the rules are changed “in flight”.

As has been the practice for all IEEE-SA Bylaws and Ops Man changes, at least for as long as I can remember, the policy will go into effect for all groups at the same time.  This is usually Jan 1 of each year but the BoG set the date to be 30 April 2007 for these specific changes.  Of course, any pre-existing LOAs for a group are honored, i.e., there is no need for a WG Chair to go after an LOA on the new form if he already has an accepted LOA.

When they become effective on April 30, 2007, will they apply only to projects (new standards or revisions, etc.) that begin after that time?  Or is the intent to have it apply to projects mid-stream?
