Dear Dave, Thanks for circulating the draft FAQ updates. The opportunity to provide feedback is welcomed. Fraunhofer will send their comments in the excel form in
due time. In order to prepare our feedback, we would appreciate if you could please provide us with a link to the documents referred to in the June 2019 LOA form. The “custom LOA form dated 13 June 2019 – Limited” makes reference to “IEEE Patent Policy, IEEE-SA Standards Board Bylaws, and IEEE-SA Standards Board
Operations Manual in effect as of 14 March 2015”. Perhaps we are not looking in the right place, as these documents, the LOA form applied to the 2007 policy, and past versions of the FAQs do appear to be accessible on IEEE´s website.
As a separate query, we would appreciate any background that you can share on the preparation of the 2019 custom LOA form. In the
IEEE SA Statement on the “custom LOA form dated 13 June 2019 – Limited” it was noted that such LOA “shall be made available to patent holders as an opportunity to provide licensing assurance
in accordance with the IEEE patent policy that was in effect on 14 March 2015 for any standards project that was initiated, based on PAR approval date, prior to 15 March 2015” (emphasis added). Could you please share why IEEE has drafted the “custom
LOA form dated 13 June 2019 – Limited” instead of just using the old LOA applicable under the 2007 policy? Please see the attached clean and redline versions. PatCom is seeking review of the draft FAQ updates at this time. [It is anticipated that a final draft version of updated FAQs will be considered for approval at the November 2019 PatCom meeting.] If you wish to submit comments, please do so by 29 August 2019. Please note that PatCom requests that comments be limited to the FAQs with proposed updates, other existing FAQs that have relevance to the custom LOA form, and suggestions for potential new FAQs with relevance
