I have the following concerns related to the PAR on the unlicensed use of
the VHF/UHF TV broadcast bands:
1. According to Section 12, Scope of Proposed Project, the project is targeting
"fixed point-to-multipoint wireless regional area networks operating in the VHF/UHF
TV broadcast bands between 54 MHz and 862 MHz". However, the frequency range given
actually overlaps the US cellular spectrum at 824-849 MHz and the public safety
bands at 806-824 MHz and 851-869 MHz. Also, several UHF TV channels have already
been reallocated to other uses including commercial mobile radio services (CMRS) in
channels 52-59 (698-746 MHz) and public safety in 764-776 MHz and 794-806 MHz. In
addition, the FCC has announced that the proposed spectrum sharing will not be allowed
in channels 2-4 (54-72 MHz), channel 37, and channels above channel 51.
2. According to the 5 Criteria section on Distinct Identify, "No current 802 wireless
standard specifies operation in the VHF and lower portion of the UHF spectrum, i.e., the
TV bands...." However, this seems to be partially incorrect since the 802.20 PAR states
that 802.20 will address systems "operating in licensed bands below 3.5 GHz".

The 801.18 Study Group on TV band sharing has approved a PAR and 5 Criteria for requested approval by the 802 Executive Committee at the July Plenary.
