Re: [802SEC] Indemnification memo

Bob:

I wish I could claim credit for the idea. Mr. Law asked me if I thought
it should be posted on the 802.3 site, and my only contribution was to
conclude that if it was approprate for 802.3 posting, it was appropriate
for LMSC posting.

All:

While I agree that the list isn't comprehensive of all cases of bad
faith conduct, the letter makes it clear the descriptions are "two
examples". I have been a consultant on standards projects and I didn't
find the examples insulting thinking about it in that light. I'm also a
WG Chair and didn't find the use of a WG Chair example insulting to me
in that position. Rather I read them as two cases that provoke thought
about other cases not likely to engender BOG endorsement of
indemnification.

The more cases we attempt to list, the more it implies that anything not
on the list is acceptable conduct, and I'm confident we will fail at
documenting all cases of company or interest group coersion of votes or
manipulation of process. Worse than the possibility of some individuals
in certain groups feeling slighted by being used in an example would be
to mislead readers to think they might be indemnified because their
particular scheme for manipulating the process wasn't listed in the
memo.

Bob,

Thank you for a very good idea. The memo is now linked from the
www.ieee802.org/devdocs.html page.

Paul:

I will forward to the 802.3 reflector. I think it would be appropriate
also to post this on the LMSC web pages (e.g., linked from
http://www.ieee802.org/devdocs.html), and WGs may choose to point to it
from their own pages.

Subject: [802SEC] Indemnification memo

Dear EC Members,

Please circulate the attached memo on indemnification to your Working
Group and Technical Advisory Group participants as soon as possible. As
you are all aware, this is an important subject that all members should
be aware of. If there are any questions, I will attempt address them
directly or solicit input from the appropriate legal resources in the
IEEE SA.

Regards,
