It was discussed at Patcom December 5 that
IEEE might request a business review letter from DOJ

It is interesting that in
one instance where the DOJ provided a business review letter
involving standards and a patent pool the requestors of the business review
letter were subsequently sued on multiple grounds including
"misrepresenting the nature of
their licensing activities to the DOJ" The matter has not concluded and I have no knowledge or opinion of
the merits.
