I was looking for litigation that might be relevant to ex ante
discussions of IP licensing terms. With a google search using terms
"antitrust, standard, prices, discussion, cases" regrettably I found no
cases. Are list members aware of any cases that might help us
consider IEEE policy and procedure? Or are list members aware of other SDOs or
associations that have processes relevant to ex ante discussions of IP licensing
terms?
But the google search terms produced a gold mine
of "antitrust policies" by various standards developers and
associations. The associations and SDOs are diverse and
have not much in common except their early listing in a google search. All
of the below have good summaries of antitrust risks in
standards setting and association business including prohibitions
against discussion of prices.
I believe when we contemplate IEEE procedures we might benefit
from understanding how what we are proposing is like or unlike the
behaviors that are apparently routinely banned by association
and SDO antitrust policy
